Inherited property in Monroe

What families find in Monroe.

Williamstown, on the Black Horse Pike where Routes 42 and 322 share the road, is the center of Monroe Township, which counted about 37,100 people in 2020. Its neighbors are Washington Township, Glassboro, Franklin and Clayton in Gloucester County, and Folsom, Buena Vista and Winslow beyond the county line. Created in 1859, the township takes in New Brooklyn, Downer, Cross Keys, Victory Lakes and Cecil as well as Williamstown. Inherited homes range from older houses in town to wooded lots under Pinelands rules.

Pinelands rules on the land

The Pinelands Commission includes Monroe among Pinelands Area municipalities, so the Pinelands land-use regulations apply to township land. They can restrict additions, subdivision or new construction on certain lots. Heirs who assumed a parent's large lot could be divided may find otherwise. Gembrook looks at the property under the rules that apply to it now.

Old Williamstown houses

Williamstown was called Squankum until 1842, and glassmaking began there in the 1830s, followed by the John Sharp Canning Co. around 1870. A parent's house near the old center may still have heating, plumbing or wiring from decades back. If it sits empty while the estate is settled, small problems can grow. We take these houses as they stand.

Wells and wooded lots

Before it became Cecil in 1883, the settlement was Coles Mills, with a sawmill and some of the area's first cranberry growers, and Victory Lakes is home to about 2,000 people. Homes in the outlying sections may depend on a well and septic system, and the estate may have no records for either. We do not need the family to produce them before selling.

Probate for a Monroe property

The Gloucester County Surrogate's Court, handled for you.

In New Jersey, an estate is opened in the county where the person who passed away lived. For Gloucester County that's the Gloucester County Surrogate's Court in Woodbury. With a will, the executor is appointed there; without one, an administrator is appointed, and the other heirs typically sign renunciations.

Before an inherited house can be sold, New Jersey also usually needs an inheritance tax waiver — or, for close family, an affidavit — and any liens, judgments or back taxes have to be resolved. We coordinate all of it for you. Read our full New Jersey probate guide →

Monroe questions

Our parents' Williamstown lot is under Pinelands rules. Can the heirs split it up or build on it before selling?

That depends on the Pinelands rules for that specific lot, which the Pinelands Commission or a land-use attorney can explain. Gembrook can also take the property as it is, without the family pursuing any approvals.

Do you consider inherited homes in Cecil, Cross Keys and Victory Lakes?

Yes. We look at inherited properties across all of Monroe Township's sections and talk with each heir separately about the terms.

Where is probate filed for a house in Monroe?

Probate for someone who lived in Monroe is handled by the Gloucester County Surrogate's Court in Woodbury. That's where a will is admitted, or an administrator is appointed when there's no will. When your family sells to Gembrook Properties, we handle this step with you, and in most cases you just sign where needed.

Can you cover the probate costs for a Monroe property?

Yes, when your family sells the inherited property to Gembrook Properties. In many cases we cover the cost of opening the estate, including the family's estate attorney fees, so the family pays nothing out of pocket.

What if the heirs don't agree?

That's common. We speak with each heir separately and privately, so no one has to negotiate as a group, and the executor or court-appointed administrator signs the sale.
