Inherited property in Oakland

What families find in Oakland.

Oakland covers almost 9 square miles in northwest Bergen County along the Ramapo River, with Ramapo Valley Road (U.S. 202) as its downtown and Interstate 287 crossing it. It includes Ramapo Lake, Rotten Pond, a former bungalow-colony valley in West Oakland, and a share of Ramapo Mountain State Forest. The borough has about 4,600 homes, some of which began as summer cottages. Many families settling an estate here have to account for river flooding, Highlands rules, or both.

Living with the Ramapo

Roughly 1.2 square miles of the borough falls within FEMA's 100-year floodplain, largely beside the river, and floods struck in 2007 and 2010 and twice more in 2011; Irene's remains the flood of record. Under floodplain rules, repairs that reach half of a home's value bring new-construction rules into play, which can turn restoration into a much bigger job. We purchase the home in its existing state.

From cottage to house

From the 1940s into the late 1960s, summer bungalows filled a valley in West Oakland beside the Ramapo, and the old Pleasureland resort has since become parkland within Great Oak Park. A parent's house that started as a cottage may have a small footprint and later additions that lack full records. We review it ourselves and buy it without asking for upgrades.

Highlands and forest land

The 2004 Highlands Act placed Oakland in its preservation area, and a section of the Ramapo Mountain forest, entered from Skyline Drive, lies within the borough. Heirs who hoped to divide a parent's lot or build on it may find that harder than expected, which affects what the land is worth. We buy the property as it is now, with no approvals for the family to seek.

Probate for a Oakland property

The Bergen County Surrogate's Court, handled for you.

In New Jersey, an estate is opened in the county where the person who passed away lived. For Bergen County that's the Bergen County Surrogate's Court in Hackensack. With a will, the executor is appointed there; without one, an administrator is appointed, and the other heirs typically sign renunciations.

Before an inherited house can be sold, New Jersey also usually needs an inheritance tax waiver — or, for close family, an affidavit — and any liens, judgments or back taxes have to be resolved. We coordinate all of it for you. Read our full New Jersey probate guide →

Oakland questions

Our parents' Oakland house sits in the river's floodplain and was damaged. Does the estate have to elevate or rebuild it?

Not to sell to us. We purchase flood-zone houses in their current state, so the estate doesn't have to take on elevation or restoration work.

Mom's West Oakland house started as a summer cottage. Will that cause a problem?

No. We purchase converted seasonal homes, including ones with additions that lack full records, and review the property ourselves.

Where is probate filed for a house in Oakland?

Probate for someone who lived in Oakland is handled by the Bergen County Surrogate's Court in Hackensack. That's where a will is admitted, or an administrator is appointed when there's no will. When your family sells to Gembrook Properties, we handle this step with you, and in most cases you just sign where needed.

Can you cover the probate costs for a Oakland property?

Yes, when your family sells the inherited property to Gembrook Properties. In many cases we cover the cost of opening the estate, including the family's estate attorney fees, so the family pays nothing out of pocket.

What if the heirs don't agree?

That's common. We speak with each heir separately and privately, so no one has to negotiate as a group, and the executor or court-appointed administrator signs the sale.
