Inherited property in Pequannock

What families find in Pequannock.

Pequannock Township lies in northeastern Morris County along the Pompton River valley, with Pompton Plains making up most of it and Old Pequannock in the south. Route 23 follows its eastern edge. Dating to 1740, it was once the largest township in the county before many neighbors were carved from it. For heirs, the big local question is often water: two rivers, the Pequannock and the Pompton, form the township's eastern line, and many homes have flooded before.

Irene and the rivers

Irene's 2011 flooding reached roughly 1,100 homes, about 40 percent of all those in the township, and no street floods as often as Harrison Road. A parent's house with that history may carry flood insurance and unresolved repairs while the estate is open. We buy those houses as they stand and work through the estate side with the family.

Buyouts and elevation

Around 87 homes in flood-prone spots, chiefly along Harrison Road, Riverside Drive and Pequannock Avenue, were bought out and torn down using FEMA and county money, and the township has since shifted toward elevating homes. Heirs may wonder whether to pursue those programs. That is the family's call; if they would rather not, we take the property as it is.

Bungalows made year-round

In the southern part of the township, some former vacation bungalows were converted into year-round homes. The 1872 Pompton Plains railroad station now holds the township museum. A converted bungalow left to heirs can have a patchwork of improvements from different owners. We don't ask the family to sort those out before the estate sells.

Probate for a Pequannock property

The Morris County Surrogate's Court, handled for you.

In New Jersey, an estate is opened in the county where the person who passed away lived. For Morris County that's the Morris County Surrogate's Court in Morristown. With a will, the executor is appointed there; without one, an administrator is appointed, and the other heirs typically sign renunciations.

Before an inherited house can be sold, New Jersey also usually needs an inheritance tax waiver — or, for close family, an affidavit — and any liens, judgments or back taxes have to be resolved. We coordinate all of it for you. Read our full New Jersey probate guide →

Pequannock questions

Dad's house on Harrison Road flooded in Irene. Can the estate sell it anyway?

Yes. We buy inherited houses in the township that have flooded as they stand, without requiring the family to repair or elevate first.

Is Pompton Plains a separate town from Pequannock?

No. Pompton Plains is the largest part of Pequannock Township, and we work with estates throughout the township.

Where is probate filed for a house in Pequannock?

Probate for someone who lived in Pequannock is handled by the Morris County Surrogate's Court in Morristown. That's where a will is admitted, or an administrator is appointed when there's no will. When your family sells to Gembrook Properties, we handle this step with you, and in most cases you just sign where needed.

Can you cover the probate costs for a Pequannock property?

Yes, when your family sells the inherited property to Gembrook Properties. In many cases we cover the cost of opening the estate, including the family's estate attorney fees, so the family pays nothing out of pocket.

What if the heirs don't agree?

That's common. We speak with each heir separately and privately, so no one has to negotiate as a group, and the executor or court-appointed administrator signs the sale.
