An inherited house in Seaside Park, handled with care.

Inherited property in Seaside Park
What families find in Seaside Park.
Seaside Park lies on the Barnegat Peninsula just south of Seaside Heights, the last borough before Route 35 reaches Island Beach State Park. The borough was carved from Berkeley Township in 1898 and grew to the north when it absorbed the Berkeley Tract in 1900. More recently, in March 2026, the borough agreed to take in South Seaside Park. With about 2,700 homes counted in 2010 but just 833 households living in them full time, the house a family inherits here is usually a shore home their parents kept for summers.
South Seaside Park changes
Residents of South Seaside Park petitioned in 2014 to leave Berkeley Township, and the borough approved annexing the neighborhood of roughly 450 residents in March 2026. A parent's records there may name Berkeley for taxes and permits. We sort out which municipality's records apply as part of the title work.
Water inside the house
Floodwater from Sandy stood about 4.4 feet deep in parts of the borough and destroyed its boardwalk. A parent who stayed may have rebuilt partly, fully, or not at all. Whatever was done, the estate does not need to finish it first. We take the house in its present state, raised or not.
Heirs in other places
Most homes here are second homes, and the people who inherit them often live elsewhere. We talk with each heir separately by phone, so no one has to travel repeatedly or speak for the others. Homes close to the boardwalk can also carry history from the 2013 fire that began at Funtown Pier, and we take that into account ourselves.
Probate for a Seaside Park property
The Ocean County Surrogate's Court, handled for you.
In New Jersey, an estate is opened in the county where the person who passed away lived. For Ocean County that's the Ocean County Surrogate's Court in Toms River. With a will, the executor is appointed there; without one, an administrator is appointed, and the other heirs typically sign renunciations.
Before an inherited house can be sold, New Jersey also usually needs an inheritance tax waiver — or, for close family, an affidavit — and any liens, judgments or back taxes have to be resolved. We coordinate all of it for you. Read our full New Jersey probate guide →

Seaside Park questions
Mom's house is in South Seaside Park. Is it Berkeley Township or Seaside Park now?
The borough voted in March 2026 to annex the neighborhood, so records may be changing over. Our title review confirms which municipality the property is in before closing.
The house took water in Sandy and was only partly repaired. Will the estate have to finish the work?
No. We purchase homes that flooded, whatever stage the repairs reached.
Where is probate filed for a house in Seaside Park?
Probate for someone who lived in Seaside Park is handled by the Ocean County Surrogate's Court in Toms River. That's where a will is admitted, or an administrator is appointed when there's no will. When your family sells to Gembrook Properties, we handle this step with you, and in most cases you just sign where needed.
Can you cover the probate costs for a Seaside Park property?
Yes, when your family sells the inherited property to Gembrook Properties. In many cases we cover the cost of opening the estate, including the family's estate attorney fees, so the family pays nothing out of pocket.
What if the heirs don't agree?
That's common. We speak with each heir separately and privately, so no one has to negotiate as a group, and the executor or court-appointed administrator signs the sale.
