Inherited property in Walpack

What families find in Walpack.

In western Sussex County, Walpack Township occupies part of the Minisink Valley on the Delaware, between Sandyston, Stillwater and Hardwick. Most of the valley was acquired by eminent domain for a Tocks Island dam that never materialized, and the 2020 census recorded just seven residents, fewer than any other municipality in the state. A family that still holds private property here faces an unusual estate, with very few comparable homes, a layered title history and land surrounded by federal parkland.

After Tocks Island

A Delaware River dam was proposed in 1962 after the 1955 floods, and over about 15 years some 72,000 acres, Walpack among them, were taken by eminent domain. The plan ended after the river received federal protection from Congress in 1978. Any parcel still in private hands may have a complicated deed history. Gembrook's title work goes through it with the estate attorney.

Fifteen homes on record

The 2010 census counted just 15 housing units in Walpack. With so few houses, there is almost no local sales history to guide heirs on value. Gembrook reviews a Walpack property individually and explains to the family how we arrived at our figure.

Walpack Center

National Register listings here include the Wallpack Center Historic District, from 1980, and the Andrew Snable House, built in 1801 and listed in 1979. The township maintains all 20 miles of its roads. A historic or remote family property here needs a buyer comfortable with its age and location; Gembrook looks at it as it stands.

Probate for a Walpack property

The Sussex County Surrogate's Court, handled for you.

In New Jersey, an estate is opened in the county where the person who passed away lived. For Sussex County that's the Sussex County Surrogate's Court in Newton. With a will, the executor is appointed there; without one, an administrator is appointed, and the other heirs typically sign renunciations.

Before an inherited house can be sold, New Jersey also usually needs an inheritance tax waiver — or, for close family, an affidavit — and any liens, judgments or back taxes have to be resolved. We coordinate all of it for you. Read our full New Jersey probate guide →

Walpack questions

Our family kept land in Walpack through the Tocks Island years. Can the estate still sell it?

Privately held property can still be sold. We review the deed history and boundaries carefully, then talk with the family about what we can do.

The property tax on Dad's Walpack land is low. Does that make things easier for the estate?

In 2018 the average Walpack tax bill came to $450, lower than anywhere else in the county, which keeps carrying costs down. The property's value and the sale terms still depend on the land itself, which we review with the heirs.

Where is probate filed for a house in Walpack?

Probate for someone who lived in Walpack is handled by the Sussex County Surrogate's Court in Newton. That's where a will is admitted, or an administrator is appointed when there's no will. When your family sells to Gembrook Properties, we handle this step with you, and in most cases you just sign where needed.

Can you cover the probate costs for a Walpack property?

Yes, when your family sells the inherited property to Gembrook Properties. In many cases we cover the cost of opening the estate, including the family's estate attorney fees, so the family pays nothing out of pocket.

What if the heirs don't agree?

That's common. We speak with each heir separately and privately, so no one has to negotiate as a group, and the executor or court-appointed administrator signs the sale.
