Inherited property in Wharton

What families find in Wharton.

Wharton is a two-square-mile borough in the north-central part of Morris County, with Jefferson, Roxbury, Rockaway Township, Mine Hill and Dover around it and Route 15 and Interstate 80 crossing it. Incorporated in 1895 under the name Port Oram, it was a town built on iron and the canal, renamed for Joseph Wharton in 1902. Inherited houses here are often older homes from the town's industrial years, some on low ground near the Rockaway River.

Port Oram's iron years

From 1831 the Morris Canal passed through Port Oram, bringing coal and shipping iron ore, and iron works rose along its banks. Nine acres of the canal, Lock 2 among them, survive in Hugh Force Canal Park. A parent's house from those early decades may need systems work the heirs would rather not oversee. We take it as it stands.

Along the Rockaway

Near Wharton the Rockaway River bends east toward Dover, and it once fed into the Morris Canal here. A house on low ground near the river may bring insurance questions while it sits empty during the estate. We work through the estate side with the family and buy the property as it is.

Planning Area borough

All of Wharton is Highlands Planning Area, and its population rose roughly 11 percent from 2010 to 2020. Newer housing nearby means an older inherited home gets measured against updated ones. Heirs don't have to renovate to compete; we speak with each of them privately about selling the house as it stands.

Probate for a Wharton property

The Morris County Surrogate's Court, handled for you.

In New Jersey, an estate is opened in the county where the person who passed away lived. For Morris County that's the Morris County Surrogate's Court in Morristown. With a will, the executor is appointed there; without one, an administrator is appointed, and the other heirs typically sign renunciations.

Before an inherited house can be sold, New Jersey also usually needs an inheritance tax waiver — or, for close family, an affidavit — and any liens, judgments or back taxes have to be resolved. We coordinate all of it for you. Read our full New Jersey probate guide →

Wharton questions

Grandpa's old deed says Port Oram. Is that Wharton?

Yes. Port Oram was the borough's name at incorporation in 1895, and it became Wharton in 1902.

The Wharton house hasn't been touched in decades. Does the estate have to fix it up first?

No. We buy inherited houses in the borough as they stand, so the heirs don't need to arrange repairs or updates.

Where is probate filed for a house in Wharton?

Probate for someone who lived in Wharton is handled by the Morris County Surrogate's Court in Morristown. That's where a will is admitted, or an administrator is appointed when there's no will. When your family sells to Gembrook Properties, we handle this step with you, and in most cases you just sign where needed.

Can you cover the probate costs for a Wharton property?

Yes, when your family sells the inherited property to Gembrook Properties. In many cases we cover the cost of opening the estate, including the family's estate attorney fees, so the family pays nothing out of pocket.

What if the heirs don't agree?

That's common. We speak with each heir separately and privately, so no one has to negotiate as a group, and the executor or court-appointed administrator signs the sale.
